Section BMass. Business Data Security Regs To Impact All Firms

With new state requirements effective March 1, designed to protect consumers from identity theft, the Massachusetts Restaurant Association’s Educational Foundation recently hosted a seminar that outlined the new security regulations and extensive set of standards. The seminar, titled “New Developments in Information Privacy and Security: What Every Business Needs to Know” was presented by Foley Hoag LLP partners Colin Zick and Robert Fisher.
The new chapter of the General Laws of Massachusetts—93H—is intended to protect Massachusetts residents from identity theft and applies to any business entity that owns, licenses, maintains or stores personal information of a Massachusetts resident.
Organizations should designate an individual who will be responsible for their information security program; develop a written information security policy; identify what personal information their business possesses, where it is kept, and who has access to it; place reasonable restrictions on access to personal information: Other suggested measures include: taking steps to ensure that third-party service providers have the capacity to protect personal information; prevent terminated employees from accessing personal information; monitor and update security measures on a regular basis; and document responsive actions taken in connection with any incident involving a breach of securityBack to Home Page
